By accessing or using the Innovative Twist website located at innovativetwist.com (the "Site"), placing an order, or using any of our services, you confirm that you have read, understood, and agree to be legally bound by these Terms of Use ("Terms") and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, you must immediately discontinue use of the Site and our services. These Terms apply to all visitors, users, customers, and anyone who accesses or uses our services.

You must be at least 18 years of age and a legal resident of the United States to use this Site and place orders. By using the Site, you represent and warrant that:

• You are at least 18 years old.
• You have the legal capacity to enter into a binding contract.
• You are not prohibited from using the Site under any applicable law or regulation.
• If you are acting on behalf of a business or organization, you have the authority to bind that entity to these Terms.

We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion, including in cases where we believe a user does not meet these eligibility requirements.

You agree to use this Site only for lawful purposes and in a manner consistent with all applicable federal, state, and local laws and regulations. Specifically, you agree not to:

• Use the Site in any way that violates applicable laws or infringes on the rights of others.
• Submit or transmit any content that is unlawful, obscene, defamatory, threatening, harassing, abusive, or hateful.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Attempt to gain unauthorized access to any portion of the Site, its related systems, or networks.
• Use any automated tools, bots, scrapers, or scripts to access or harvest data from the Site without our prior written consent.
• Engage in any activity that disrupts, damages, or impairs the Site's functionality or the experience of other users.
• Upload files containing viruses, malware, or other malicious code.
• Reproduce, duplicate, copy, sell, or exploit any portion of the Site for commercial purposes without our express written permission.

We reserve the right to terminate or restrict your access to the Site at any time, without notice, for any conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

All orders placed through our Site are subject to acceptance and product availability. We reserve the right to refuse or cancel any order at any time, including after confirmation, for reasons such as pricing errors, suspected fraud, or inability to fulfill the order.

Product Descriptions

We make every effort to display product colors, finishes, and specifications as accurately as possible. However, we cannot guarantee that your monitor's display of any color or finish will be perfectly accurate. Slight variations in color, size, or finish may occur between orders due to the nature of the printing process and materials used.

Pricing

All prices are listed in U.S. dollars and are subject to change without notice. Prices displayed on the Site do not include applicable taxes or shipping fees, which will be calculated and displayed at checkout. We reserve the right to correct pricing errors even after an order has been placed. In the event of a pricing error, we will notify you and give you the option to proceed at the correct price or cancel your order.

Quantity Requirements

Certain products have minimum order quantities. These are clearly indicated on individual product pages. Ordering below the stated minimum is not available.

Payment is required in full at the time of order placement. We accept the following payment methods as displayed at checkout:

• Visa, Mastercard, American Express, and Discover credit and debit cards.
• Apple Pay and Google Pay (where available).
• Other payment methods as made available from time to time.

All payment transactions are processed through secure, encrypted third-party payment processors. Innovative Twist does not store your full credit card number on our servers. By submitting a payment, you represent that you are authorized to use the payment method provided.

Sales Tax

Applicable sales tax will be collected on orders shipped to Virginia and any other states where we are required by law to collect sales tax. Tax rates are calculated based on the ship-to address and will be displayed at checkout prior to order confirmation.

Failed Payments

If a payment is declined or reversed after an order has begun production, we reserve the right to halt production, contact you to resolve the payment issue, and pursue collection of amounts owed. You are responsible for all fees associated with collecting unpaid balances.

You are solely responsible for the accuracy, quality, and legality of the files you submit for printing. By submitting artwork or design files, you represent and warrant that:

• You own the artwork or have obtained all necessary rights, licenses, and permissions to use and print it.
• The content does not infringe any copyright, trademark, trade secret, or other intellectual property rights of any third party.
• The content complies with all applicable laws and does not contain unlawful, obscene, defamatory, or otherwise prohibited material.
• The files meet our technical specifications (resolution, color mode, bleed, safe zones) as outlined in our file preparation guidelines.

Artwork Review

We perform a basic preflight check on submitted files to identify obvious technical issues such as low resolution, missing bleed, or incorrect color mode. However, our preflight review does not constitute a comprehensive proof review. We are not responsible for:

• Spelling, grammar, or typographical errors in customer-supplied content.
• Color shifts between screen display and printed output (screen-to-print color variation is normal).
• Design choices including layout, font selection, image placement, or overall visual appearance.
• Low-resolution images that appear acceptable on screen but print poorly.
• Files that do not meet our bleed, safe zone, or margin requirements.

Prohibited Content

We will not print content that is illegal, obscene, promotes hatred or violence, infringes intellectual property rights, or that we deem inappropriate at our sole discretion. We reserve the right to refuse any print job for any reason without obligation to explain.

Turnaround time is the number of business days required to produce your order after all of the following conditions are met:

• Full payment has been received and cleared.
• Approved, print-ready artwork has been confirmed.
• All order details (size, quantity, options) have been finalized.

Business days are Monday through Friday, excluding federal holidays. Turnaround times are estimates based on normal production conditions and do not constitute a guarantee of delivery by a specific date.

Rush Orders

Rush production options may be available for select products at an additional cost. Rush availability is not guaranteed and depends on current production capacity. Contact us before placing a rush order to confirm availability.

Delays

Innovative Twist is not responsible for production delays caused by circumstances outside our reasonable control, including but not limited to equipment failures, material shortages, natural disasters, acts of God, labor disruptions, or shipping carrier delays. We will make reasonable efforts to notify you of significant delays.

We ship to addresses within the contiguous United States. Shipping rates and estimated delivery times are calculated based on the destination address, order weight, and selected shipping method. All shipping costs are the responsibility of the customer and will be displayed at checkout.

Carrier Responsibility

Once an order is handed to the shipping carrier, Innovative Twist is no longer responsible for the package. We are not liable for delays, damage, or loss that occurs during transit. If your shipment is damaged or lost, you must file a claim directly with the carrier. We will provide tracking information and assist with documentation where possible.

Incorrect Addresses

You are responsible for providing an accurate and complete shipping address. Orders shipped to an incorrect address provided by the customer will not qualify for reprint or refund. Additional shipping charges may apply to re-route or reship a package.

Delivery Confirmation

Delivery confirmation by the carrier is considered delivery of the order. If a package is shown as delivered but you have not received it, please check with neighbors, building management, or your local post office before contacting us.

Due to the custom, made-to-order nature of all printed products, all sales are final. We do not accept returns or exchanges for products that have been produced to your specifications.

Manufacturing Defects

If you receive an order that contains a manufacturing defect (a print defect caused by our production process, not customer artwork errors), please contact us within 5 business days of the confirmed delivery date with:

• Your order number.
• Clear photographs of the defective items.
• A description of the defect.

At our sole discretion, we may offer a reprint, store credit, or partial refund for verified manufacturing defects. We do not provide refunds for errors in customer-supplied artwork.

Cancellations

Orders may only be cancelled before artwork has been approved and production has begun. Once production starts, cancellations are not possible and no refund will be issued. If you need to cancel, contact us immediately by email at info@innovativetwist.com and we will advise whether cancellation is still possible.

All content on the Innovative Twist website, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, is the property of Innovative Twist or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

Limited License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial use. This license does not permit:

• Reproduction, duplication, copying, or modification of any portion of the Site for commercial purposes.
• Distribution, sale, or sublicensing of Site content to third parties.
• Removal or alteration of copyright, trademark, or other proprietary notices.
• Use of our trademarks, trade dress, or branding without prior written permission.
• Framing or mirroring any portion of the Site on any other website.

Your Content

You retain ownership of the artwork and content you submit to us for printing. By submitting files, you grant Innovative Twist a limited, non-exclusive license to use your files solely for the purpose of fulfilling your order. We will not use your artwork for any other purpose without your explicit consent, except as permitted by our Privacy Policy.

If you submit reviews, feedback, comments, testimonials, suggestions, or other content to us (collectively, "User Content"), you grant Innovative Twist a worldwide, royalty-free, non-exclusive, perpetual license to use, reproduce, modify, adapt, publish, display, and distribute that User Content in any media for marketing, promotional, or operational purposes.

You represent that your User Content does not violate any third party's rights and that you have all necessary permissions to grant the above license. We are not obligated to use, maintain, or display any User Content.

We reserve the right to remove or refuse to post any User Content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable.

Our Site may contain links to third-party websites, services, or resources that are not owned or controlled by Innovative Twist. These links are provided for your convenience only. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites.

We use third-party services to operate our business, including payment processors, shipping carriers, email providers, and analytics tools. Your interactions with those services are governed by their respective terms and privacy policies.

By using our Site, you acknowledge and agree that Innovative Twist shall not be responsible or liable, directly or indirectly, for any damage or loss caused by your use of or reliance on any third-party website, service, or content.

THE SITE AND ALL PRODUCTS, SERVICES, AND CONTENT PROVIDED THROUGH IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, INNOVATIVE TWIST EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Warranties that the Site will be available, uninterrupted, error-free, or free of viruses or other harmful components.
• Warranties regarding the accuracy, completeness, or reliability of any content on the Site.
• Warranties that defects will be corrected.

Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you. In such cases, our warranties are limited to the maximum extent permitted by applicable law.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INNOVATIVE TWIST, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, revenue, data, goodwill, or business opportunities.
• Damages arising from your use of or inability to use the Site or our services.
• Damages arising from unauthorized access to or alteration of your data.
• Damages arising from errors in customer-supplied artwork or files.
• Damages arising from shipping carrier delays, loss, or damage.

In any event, our total aggregate liability to you for any claims arising from your use of the Site or our services shall not exceed the greater of (a) the amount you paid to us in the three (3) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100.00).

Some jurisdictions do not allow certain limitations of liability, so the above may not apply to you in full.

You agree to defend, indemnify, and hold harmless Innovative Twist and its officers, directors, employees, agents, contractors, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms.
• Any content or artwork you submit, post, or transmit through the Site.
• Your use of the Site in any manner not expressly authorized by these Terms.
• Your violation of any applicable law, rule, or regulation.
• Your infringement of any third party's intellectual property or other rights.

We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, at your expense, and you agree to cooperate with our defense of such claims.

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law principles.

Informal Resolution

Before filing any formal legal action, you agree to attempt to resolve the dispute informally by contacting us at info@innovativetwist.com. We will make good-faith efforts to resolve the dispute within 30 days of receiving written notice.

Binding Arbitration

If the dispute cannot be resolved informally, you and Innovative Twist agree to resolve any dispute through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. You waive your right to participate in a class action lawsuit or class-wide arbitration.

Jurisdiction

For any matters not subject to arbitration, you consent to exclusive jurisdiction and venue in the state and federal courts located in Virginia Beach, Virginia.

We reserve the right to update, modify, or replace these Terms at any time at our sole discretion. When we make material changes, we will update the "Last Updated" date at the top of this page. In some cases, we may also provide additional notice, such as via email or a Site banner.

Your continued use of the Site or our services after any changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Site and our services immediately.
